My daughter is 18 and no longer living with us, he lives in East Orange, New Jersey. She is driving her car without insurance. If she gets into an accident, are we going to be responsible?

At 18 years old your daughter should now be considered an adult and no longer a minor. Since she has moved out of your household and lives in East Orange, New Jersey in most cases she would be responsible if she gets into an accident.

This is unless the vehicle she is driving without insurance is a car that you own. If your name is on this vehicle then if he was in an accident and could not pay for the damages he cause on another person or property you could be held responsible for this. You would be vicariously liable since as the owner of the vehicle you are responsible for those who drive your car.

Speak to your daughter about the penalties for driving without insurance, which can include, depending on what state you are in, the car being impounded, license suspended, license plates revoked, and fines to name a few.
